Indiana Humanities Council, Inc. (“we” or “us”) understands that security and privacy are important issues for visitors to www.indianahumanities.org (and any extension thereof) (collectively the “Site”) and recognize our obligations to keep your information secure and confidential. We maintain the standards set forth in this Privacy Policy to help protect information that personally identifies you. By using the Site or any of the services offered thereon or in connection therewith (the “Services”), you agree to comply with and be bound by all terms, conditions and notices contained or referenced in this Privacy Policy and the Terms and Conditions of Use, which we also urge you to read. Collection of Information

You may be asked to voluntarily provide your name, age, email address, home address, date of birth, ethnicity, telephone number, credit card information or other personally identifiable information ("Personal Information") to have access to some features of the Site and/or the Services. By using the Site and/or the Services and providing us with your Personal Information, you consent to our use of such information as described in this Privacy Policy. You may always refuse to provide your Personal Information, but this may lead to our inability to provide you with certain access or services.

We or our business partners may also collect information that is anonymous, such as the name of the domain and host from which you access the Internet (for example, "aol.com"); the Internet Protocol ("IP") address of the computer you are using (an IP address is a number that is automatically assigned to your computer by your Internet Service Provider); the browser software you use and your operating system; and the Internet address of the website from which you linked directly to the Site (collectively, "Anonymous Information"), through the use of cookies or by other means. We hope that, by using Anonymous Information, we can update the Site to make it more useful to you and other users. Use of Information

We may use your Personal Information for the following purposes: to process a donation, register and administer your account; to process your registration for, and facilitate your membership and participation in, our events; to administer and improve the Site, the Services, and related products, services and events; to notify you of our products, services, events or special offers that may be of interest to you; to conduct contests and other promotions as authorized by you in connection with such contests and other promotions; to conduct surveys and solicit feedback regarding the Site, the Services, and our products, services and events; to respond to your comments, questions or suggestions; to provide Internet security; and to meet legal requirements. We may work with our business partners who may perform certain functions on our behalf, including without limitation processing registrations; fulfilling orders; sending communications related to our products, services and events; conducting, and preparing materials for, our events; photographing your participation in our events; responding to your inquiries; managing contests and other promotions; managing data; processing credit card payments; or providing customer service. These business partners have access to your Personal Information only to the extent necessary to perform these specific functions and may not use it for any other purpose.

Other than for the specific purposes set forth in this Privacy Policy, we will not disclose your Personal Information unless we obtain your prior consent or are legally required to do so. We may use third party advertising companies to place ads on the Site and to place our ads on other websites. These companies may use Anonymous Information about your visits to this and other websites to provide advertisements on the Site and other sites about products and services that may be of interest to you. If we are involved in the sale of a substantial portion of its business assets, Anonymous or Personal Information may be among the transferred assets.

Forums

We may provide chat rooms, discussion boards, online forums and other interactive technologies (collectively, "Forums") to users of the Site. Any information that is disclosed in the Forums is public information and users should exercise caution when deciding to disclose Personal Information. If you voluntarily disclose Personal Information in a public area of the Site, such as a Forum, that information may be collected and used by a third party to send you unsolicited messages, advertisements or for other purposes. We do not control the actions of third parties in Forums and other public areas of the Site. If you disclose Personal Information in a public area, you do so at your own risk. Further, any communications within the Site and Forums travel through our servers and any such communications that you send or receive may be monitored by us.

Cookies

When you visit the Site, we or a third party advertiser may store or recognize some information on your computer in the form of a "cookie" or similar file that can help us in many ways. A cookie is a bit of information that is stored on a visitor's hard drive that allows the Site to track how a visitor navigates through the Site and areas in which a visitor shows interest. Security

We have policies and procedures in place to protect the privacy and confidentiality of your Personal Information that it collects and maintains. We have industry standard security programs intended to keep Personal Information stored in systems and servers shielded from unauthorized access. All Personal Information is stored in secure data centers located within the United States. These systems are configured with data encryption or other scrambling technologies and firewalls constructed to high industry standards. Any unauthorized use of the Site may result in criminal and/or civil prosecution.

We will use all reasonable efforts to safeguard the privacy of your Personal Information; nonetheless transmissions on the Internet cannot be made absolutely secure. We assume no responsibility or liability for disclosure of any of your Personal Information due to errors in transmission, unauthorized third-party access or other causes beyond our reasonable control.

Web Privacy Policy For Users Age 13 and Under

We are very sensitive to the safety of children; therefore, we do not collect or store information on users under the age of 13. If a user under the age of 13 contacts us via the Site, we will respond to the user once by email in accordance with Federal Trade Commission regulations. Any Personal Information provided to us by a user under the age of 13 will not be sold, distributed to a third party or utilized, other than to communicate to the user by email our denial of access to the Site. We encourage all parents to assist their children in accessing information via the Internet. We continuously monitor the Site for content that is inappropriate for children. 1. Acceptance of Terms and Conditions of Use

Welcome to Indiana Humanities Council, Inc.’s (“we” or “us”) website www.indianahumanities.org (and any extension thereof) (collectively the “Site”). By accessing the Site or using any of the services offered thereon or in connection therewith (the “Services”), you agree to be bound by these terms and conditions of use (these “Terms”) and all applicable federal, state, and local laws and regulations. If you do not agree to be bound by these Terms, you are prohibited from accessing the Site.

2. Privacy Policy

Our Privacy Policy (the “Policy”) describes how we handle your personal information when you use the Site or the Services. The Policy is part of and is incorporated into these Terms. You may view or print the current version of the Policy by clicking here.

Under no circumstances shall we be liable in any way for any Materials or any loss or damage of any kind incurred as a result of the use of our Materials.

5. License Grant

6. Your Use of the Site and the Services

You will not engage in any data mining in connection with the Site and/or the Services. We reserve all rights and remedies available to us including reporting any breach to the relevant law enforcement authorities and cooperating with those authorities by disclosing your identity to them.

7. Submissions

You retain your rights to any material or content you submit, post or display on or through the Site and/or the Services, including but not limited to any comments, remarks, suggestions, ideas, notes, drawings, graphics, pictures, concepts, data, or other user-generated content (collectively, the “UGC”). By submitting, posting, or displaying UGC on or through the Site and/or the Services, you grant us a worldwide, non-exclusive, royalty-free, sub-licensable, irrevocable license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such UGC in any and all media (whether known or later developed).

In connection with your use of the Site and/or the Services, you agree not to submit or transmit any material that is unlawful, threatening, libelous, defamatory, obscene, pornographic, profane, or might in any other way violate any law, regulation, or rule. You are solely responsible for any material you submit through the Site and/or the Services. You further agree not to upload, email, post or transmit to, or distribute or otherwise publish through the Site and/or the Services any material which disrupts the normal operation of the Site and/or the Services, including posting or otherwise transmitting material that is not related to the subject at issue or otherwise restricts or inhibits any other user from using the Site and/or the Services.

Through your usage of the Site and/or the Services, you may submit and/or we may gather certain limited information about you and your use of the Site and/or the Services, and we may use this information in accordance with the Policy (which is part of the Terms and incorporated herein by reference).

8. Digital Millennium Copyright Act Compliance

If you are a copyright owner or an agent thereof, and you believe that any content hosted on the Site infringes your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act ("DMCA") by providing Our Designated Copyright Agent with the following information in writing (see 17 U.S.C § 512(c)(3) for further detail):

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;

  • Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted;
  • A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
  • A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

9. Links to Third Party Sites

The Site and/or the Services may provide links to sites operated by third parties. The linked sites are not under our control, and we are not responsible for the content of any linked site or subsequent links from that site. We may provide links only as a courtesy to our users, but such links do not (and will not) imply our endorsement of any linked site.

10. Linking to the Site

We do not object to you linking directly to the information that is hosted on the Site, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You may not establish a link to the Site from any website that is not owned by you. The Site must not be framed on any other site. We may withdraw linking permission without notice.

11. User Registration

To obtain access to the Services or certain sections of the Site, you may be required to complete a registration or log in via a social media account, including, but not limited to, Facebook, Twitter, YouTube or Instagram. ALL CONTENT AND SERVICES INCLUDED ON OR AVAILABLE THROUGH THE SERVICES (COLLECTIVELY, "OUR CONTENT") ARE PROVIDED "AS IS", "AS AVAILABLE" AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, BY EITHER US OR ANYONE ELSE WHO HAS BEEN INVOLVED IN THE CREATION OR PRODUCTION OF OUR CONTENT, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE. 14. Indemnification

You agree to defend, indemnify, and hold us and our employees, contractors, officers and directors harmless from all liabilities, claims, and expenses, including attorney's fees, that arise from (i) your use or misuse of the Site, the Services, and/or the Materials and/or (ii) any UGC you submit, post or display on or through the Site and/or the Services. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

15. Trademarks, Trade Names, and Service Marks

Unless otherwise indicated, all logos, names, and marks on the Site are trademarks or service marks owned or used under license by us. The use or misuse of any of these marks or other information is strictly prohibited.

16. Choice of Law

The Terms shall, for all domestic and international purposes, be governed, interpreted, construed, and enforced solely and exclusively in accordance with the laws of the State of Indiana, U.S.A., without regard to conflicts of law provisions. You expressly agree that the exclusive jurisdiction for any claim or action arising out of or relating to these Terms or your use of the Site or the Content shall be filed only in the state or federal courts located in the State of Indiana, and you further agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action. All actions or proceedings arising out of or relating to the Terms shall be venued exclusively in state and federal court in Indiana. You waive any objection you may now or hereafter have with respect to venue or to convenience of such forum.

17. Integration and Severability

The Terms constitute the entire agreement between you and us with respect to the Site and the Services and supersede all prior or contemporaneous communications and proposals with respect to the Site. If any provision of the Terms is determined to be invalid or unenforceable, all other provisions shall remain in full force and effect.

18. Waiver

Our failure at any time to require performance of any provision of these Terms (including the Policy, which is incorporated by reference) or to exercise any right provided for herein or by law shall not be deemed a waiver of such provision or such right. All waivers must be in writing and signed by our authorized representative. Unless the written waiver contains an express statement to the contrary, no waiver by us of any breach of any provision of the Terms of any right provided for herein or by law shall be construed as a waiver of any continuing or succeeding breach of such provision, a waiver of the provision itself, or a waiver of any right under these Terms.

19. Termination

We reserve the right, in our sole discretion, to terminate your access to all or part of the Site and/or the Services, with or without notice.
